Net Neutrality: Court says no preferential treatment


A DC Circuit Court, Wednesday struck out the Federal Communications Commission (FCC)'s net neutrality rules, which prevents Internet Service Providers from giving preferential treatment to some online content over others, DigitalSENSE Business News reports.

This, some experts at the Public Knowledge told DigitalSENSE Business News is a disappointing loss for Internet users.

“Net neutrality is essential for an open, fair, and innovative online environment,” the group observed.

While the Court made it clear that the FCC has authority over Internet access generally, it found that the open Internet rules specifically were built on a flawed legal foundation. 

Also, the Court's ruling, they said, established that the power to create rules for Internet access is entirely under the purview of FCC.

DigitalSENSE Business News further gathered from the team that with this judgement, it is up to the FCC to decide how to exercise its authority to protect consumers and the open Internet.

As declared by the Public Knowledge team, “While we wish this decision had clearly preserved net neutrality rules once and for all, it is clear there is still much work to be done. Public Knowledge will continue to fight for net neutrality, but we can't do it alone.”
